New Executive Order Will Further Reopen Florida’s Economy
By FCA Asst. General Counsel Kim Driggers
Wednesday, 03 June 2020
Today, Governor Ron DeSantis announced his plan to move Florida counties into Phase 2 of Florida’s three-phase plan to reopen the economy. Florida is to enter Phase 2 on Friday, June 5 and will include all counties except Miami-Dade, Broward and Palm Beach counties where the highest concentration of COVID-19 cases have been reported. Those counties may seek approval to enter Phase 2 with a written request from the county mayor.

Executive Order 139
allows personal services, including massage and acupuncture (those services without a physician order), to operate with appropriate safety guidelines “as outlined by the Department of Health”.  As of this writing, the Department of Health has not yet published their safety guidelines.  You can keep watch for them at the following links:  https://floridasmassagetherapy.gov/  and https://floridasacupuncture.gov/

Phase 2 includes the reopening of bars, movie theaters, concert halls and bowling alleys. Such establishments will be permitted to operate at 50% capacity with social distancing restrictions.

The Executive Order allows restaurants and retail stores currently operating at 50% capacity under Phase 1 of the plan, to be permitted to operate at full capacity provided they practice social distancing.

Under Phase 2, gyms, in-store retailers are also authorized to operate at capacity.

Although Phase 2 does not require face coverings for your offices, you should be sure to comply with local government guidelines. You should also consider mandating that your employees wear face coverings for the safety and comfort of guests who may feel more confident entering your office with such protocols in place.
